1. Service Description

KanCAT is a software-as-a-service (SaaS) computer-assisted translation (CAT) tool provided by KanCAT ("we", "us", "KanCAT"). KanCAT is a productivity and project management tool for translators and translation agencies. It is not a financial services provider, payment institution, or electronic money institution (EMI). KanCAT does not hold, process, or transmit funds on behalf of users.

2. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or disassemble any part of the platform;
  • Scrape, crawl, or systematically extract data from the service via automated means without our written consent;
  • Resell, sublicense, or transfer access to the service to third parties without authorisation;
  • Upload content that is unlawful, defamatory, obscene, or infringes third-party intellectual property rights;
  • Attempt to circumvent billing controls, subscription tier limits, or access controls;
  • Use the service to facilitate fraud, money laundering, or any other illegal activity.

3. Accounts and Subscription Tiers

KanCAT offers multiple subscription tiers: Free, Freelancer Starter, Freelancer Professional, Team Starter, Team Pro, and Enterprise. Each tier has defined feature limits. You are responsible for maintaining the security of your account credentials.

Paid tiers (except Enterprise) include a free trial period (14 days for Freelancer tiers, 30 days for Team tiers). No charge is applied during the trial. After the trial, your payment method will be billed at the stated subscription rate unless you cancel before the trial ends.

Downgrades take effect at the end of your current billing cycle. Upgrades take effect immediately, with a pro-rated charge for the remainder of the cycle.

4. Liability Cap

To the maximum extent permitted by applicable law, our liability to you for any claim arising out of or relating to these Terms or the service is limited to the total fees you paid to us in the 12 months immediately preceding the event giving rise to the claim.

We exclude liability for indirect, incidental, special, punitive, or consequential loss, including loss of profits, loss of data, or loss of business opportunity — whether arising in contract, tort (including negligence), or otherwise.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

5. Intellectual Property Ownership

KanCAT and KanCAT retain all intellectual property rights in the platform, including the software, interface, documentation, and all underlying technology.

You retain full ownership of all translation content, source files, translation memories, glossaries, and other data you upload or create within the service. We do not claim any licence to your content beyond what is necessary to operate the service.

6. Termination

We may suspend or terminate your account if you materially breach these Terms, fail to pay subscription fees, or if we are required to do so by law. We will give reasonable notice where possible, except in cases of serious breach or legal obligation.

After termination, you have 30 days to export your data (translation memories, glossaries, XLIFF files). After this export window, your data will be deleted in accordance with our retention schedule.

You may terminate your account at any time from the account settings page. Termination does not entitle you to a refund for any unused portion of a paid billing period, except where required by applicable consumer law.

7. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

8. Changes to These Terms

We may update these Terms from time to time. We will give at least 14 days' notice of material changes via email (for registered users) and a notice on this page. Continued use of the service after the effective date constitutes acceptance.
